PARLIAMENT ARREST- COLLEGE GREEN- SOCPA (Serious Organised Crime & Police Act) 1:19pm. 14/4/10

On Wednesday 14th April approx 12:40 pm. I was stood outside 4 Millbank holding a paper sign saying “NUKILLER POWER NO”. Mr Carr holding a placard approached me expressing concerns regarding his arrest the previous day for assault and that he may be arrested again whilst displaying his placard, I said he had nothing to fear because he was protected by article 10 ECHR and agreed to go with him to college green.

On arrival at the green Mr Carr stood some distance from a BBC crew and was approached by them asking him to go away an argument broke out and Mr Carr was accusing the BBC of telling lies which had resulted in his arrest the previous day- 3 Parliamentary police officers were present and the BBC made representations to them regarding Mr Carr. It seemed the police were of the opinion that as long as Mr Carr complied with his bail conditions (That he remained10 Meters from the TV camera.) that was sufficient.

Mr Carr was stood next to me, he was displaying his placard and I was displaying my sign, the BBC were insisting that Mr Carr should go away, I remarked that they were interfering with ECHR under Article 10 and made the comment that we should democratise the media and that I had not voted for the BBC and that the BBC constitution stated that controversial issues should be treated with due impartiality and balance and that the BBC had been the greatest promoters of cigarettes, transmitting over 400 hours of tobacco sponsored programmes per year such as Embassy World Snooker etc.

PC P617 came over to me asking my details etc. I was repeating what he said in a loud voice and included my solicitors phone number, I asked the officer if I was breaking the law he said “No” He gave me a receipt saying:
“Above male spoken to by police on Abingdon Green Westminster. Male was holding a sign saying “NUKILLER POWER NO” male was shouting and causing a nuisance causing a film crew to halt filming.” (Time 12:55 pm.)

After the film crew had packed up and left the green PC P855 (Who arrested Mr Carr the previous day?) approached Mr Carr saying now the TV cameras have gone there is no need for you to be here, I remarked that Mr Carr was an intelligent man and it was up to him etc. PC P855 left; I then decided to get my soapbox from my bicycle, on return Mr Carr departed.

I stood on the soap box first quoting Article 10 (Which I dictated.) and then making a presentation regarding the dangers of Nuclear Power, I was then approached by PC P617. I accused him of being in breach of Article 10 (Interference by public authority.) And asked him to go away which is what he did. PC P409 then approached asking if I had SOCPA authorisation I said I was acting under the protection of Article 10 ECHR he said you need SOCPA I said that article 10 over ruled SOCPA he then showed me his watch asking if it was showing the correct time pointing to Big Ben, there was a tree obscuring Big Ben, when I stepped off my soap box to view he arrested me for breach of SOCPA. (Time of arrest 1:19 pm.)

I was taken to Charring Cross Police Station and when interviewed by WPC Roberts CPU I responded by saying “I was acting under the protection of Article 10 of the European Charter of Human Rights – That just about covers it!” No comment was replied to further questions. I refused the bail conditions (Which was not to enter a 1 Km. area around Parliament) was charged with section 134 (2) SOCPA, 132(1) (B) and 136(2) SOCPA 2005. My reply to the charge was “I was operating under article 10 of the ECHR and I don’t feel as though I am involved in serious organised crime… I was kept overnight taken to court the next day, the duty solicitor argued the word demonstration was not defined and Article 10 had supremacy. The judge allowed unconditional bale but said if I demonstrated I would be arrested?

ARTICLE 10 -1) Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers. This article shall not prevent States from requiring the licensing of broadcasting, television or cinema enterprises. 2) The exercise of these freedoms, since it carries with it duties and responsibilities, may be subject to such formalities, conditions, restrictions or penalties as are prescribed by law and are necessary in a democratic society, in the interests of national security, territorial integrity or public safety, for the prevention of disorder or crime, for the protection of health or morals, for the protection of the reputation or the rights of others, for preventing the disclosure of information received in confidence, or for maintaining the authority and impartiality of the judiciary.

SOCPA -134 Authorisation of demonstrations in designated area (2) The Commissioner must give authorisation for the demonstration to which the notice relates. 132 Demonstrating without authorisation in designated area (1) Any person who— (b) takes part in a demonstration in a public place in the designated area, or 136 Offences under sections 132 to 135: penalties (2) A person guilty of an offence under section 132(1) (b) or (c) is liable on summary conviction to a fine not exceeding level 3 on the standard scale.

Ice Bear Arrest

FRIDAY 11 DECEMBER 6:50 am. TRAFALGAR SQUARE. ICE BLOCK SCULPTED INTO POLAR BEAR- ARREST. (Common Assault)

After being given the go ahead by Climate Camp I displayed a banner saying "CLIMATE CAMP" in the background of press & TV cameras as the sculptors started work on the Ice block. Initially there was no problem but after 15 minutes or so, I over heard the sculptor Mark Coreth say “Inappropriate footwear”, then one of the crane crew started pushing me out of the fenced area saying they could not operate the crane while persons were inside the area. I accused him of assault but

I immediately complied & got out of the fenced area, but after reflection decided that if the press were allowed in, then so was I, I said this loudly to him. (The ice block was on the ground the sculptors had started work on it.)

I continued to display the banner. A male & female SFM security then appeared and started to push me out of the area saying I may slip on the ice-Health & Safety etc. I continued attempting to get the banner in the background shots of the press whilst stating at least 5 times that I was operating under the protection of Article 10 of the European Charter of Human Rights (Which I also dictated to them). I asked them under whose instruction they were acting-they intimated the sculptors. I also accused them of assault; the male replied he was allowed to use reasonable force.

The pushing and shoving continued for approx 5 minutes making it impossible to get in the background shot of the TV and press, at one point I shouted will someone phone the police. Just before I gave up, the male seemed to be attempting to put me on the floor, he went low and my right arm was around his neck, they had twisted me around so I was now facing the back fence, I had hold of the female’s jacket with my left hand. I then released my grip & and continued outside the cordon making speeches etc.

Saying, to the sculptors, “We are supposed to be on the same side! So why have you set your Hench men on me? The head sculptor spoke to me (Mark Correth) but it was not relevant, another WWF? Suited man (glasses) spoke to me I responded that “The situation is not logical obviously you know something I don’t and then suggested that the artists were not really concerned about climate change they were using it to get publicity etc. another suited man WWF? Apologised for what had happened saying that their insurance would be affected by me being inside the fenced area. There was no complaint of assault and I was not aware that I had hit anybody.

As I was walking away (To replace the banner) I noticed the spokesperson for Climate Camp had arrived I suggested he get banners in the background shot of TV Press, I think he went to ask WWF if this was OK? As we separated I said that I had been in conflict with them. (I noticed that the female SFM security guard seemed to over hear this?)

Whilst I was replacing the banner by the steps I was approached by 2 female community support police officers complaining about displaying the banner in the square (breach of by-laws?), they then walked over the WWF area, I then went to unlock my bike and was again approached by the 2 female community WPCs wanting my details regarding a complaint they had received from SFM security I said that I was the one that was attacked and gave my details after ascertaining the officers had SFMs details. I also stated my actions were within Article 10 (dictated)

I then went down the stairs with my bike and stood next to the fountain where I spoke to 2 witnesses who agreed that I was attacked and assaulted by the 2 SFM security guards. (Also the crane crew). After 15 minutes or so the 2 WPC community officers appeared with 2 PCs, one Indian- Mr McHugh p226307? (CW2153?) & One Chinese- Mr Chong. {Not p227605?} CW2552.

The Chinese PC & Comm. WPC went to the WWF Ice Block, whilst the Asian officer & Comm. WPC–CW7892 stayed with me by the fountain. I was told by the Asian PC that the Chinese PC was viewing the CCTV. We chatted about Climate Change and Domicile Allotments etc. I was relaxed because I knew the CCTV would prove I did not commit an assault. (I think it was the Asian officer had informed me that the accusation was that I had hit the female in the mouth with my elbow) The officers also heard the witnesses saying that I was attacked and assaulted by SFM security.

After a considerable time 20 min? The Chinese officer returned, had a brief conversation with the Asian officer then handcuffed me and said I was arrested for common assault. As I had been fully compliant I felt handcuffing was not necessary, he also said there was no CCTV however on route to the van I pointed out several CCTV cameras. (Approx 10).

After being detained 6 hours I complained to the desk sergeant regarding my detainment - I was told officers were viewing CCTV & obtaining witnesses, (I said, “What for 6 hours?”) I also complained that I was doing important work having meetings with ministers of state etc. and that I had been falsely arrested and imprisoned and that I would sue. After 15 hours I complained to inspector Newbury (Station Supervisor?) that I had been falsely arrested & imprisoned, that I was doing important work with MPs, Lord Falconer etc and would sue. I was interviewed and then charged with Battery, kept overnight taken to court the next morning and eventually released on unconditional bail at 14:55 the next day and then walked back to the place of arrest to view the National Gallery CCTV, the police had taken a copy 5 minutes before I arrived. My response to the charge sheet was, "The CCTV will prove that I committed no assault".

General Synod Assault

General Synod 2010, Assault of protestor- Church House Great Smith St Westminster

Today at approx 12:20pm I held a banner in view of the General Synod inside Church House, I was immediately attacked by approx 4 or more security guards who destroyed the paper banner which read: "JESUS WAS VEGAN TO SAVE THE WORLD FROM CLIMATE CHANGE. COMPASSION NOT KILLING! (CHECK CRUCIFIXION & CLEANSING OF TEMPLE)".

The Archbishop of Canterbury and Archbishop of York witnessed the attack, the Archbishop of York was instructing security saying “Leave him alone” etc. but the security guards ignored his instruction. When being escorted out I said in a loud voice "Geneses 1:29, Thy Kingdom come, Christians are supposed to be Vegan!" a security guard then put his hand over my mouth while I was being held by other security guards.
